Supreme Court Verdict On Eknath Shinde And Other MLAs Disqualification.In Maharashtra, today the Supreme decision has come regarding the disqualification of 15 MLAs including Chief Minister Eknath Shinde. The Supreme Court has neither given a blow nor an advantage to the Shinde group. The court said that it was unconstitutional not to make Gogwale the chief whip of the Shinde faction. The court clearly said that by calling itself the real party, it cannot escape from the ayoga. The Supreme Court says that the speaker should recognize only the whip appointed by the political party. The court said that the Speaker should take a decision on the disqualification of 16 MLAs. However, this decision of the Supreme Court will not have any effect on the Shinde government.

The decision to appoint Gogawale is unconstitutional

CJI DY Chandrachud said taking cognizance of Shinde’s statement the speaker did not undertake to identify who the whip was and he should have inquired. The decision to appoint Gogawale as chief whip was unconstitutional as a whip can only be appointed by a legislative political party.

The governor cannot interfere in the ongoing differences in the party
The Chief Justice said that the governor cannot take a decision on the basis of ongoing differences in a party. The governor cannot interfere in that matter. The Supreme Court said that floor test cannot be used to resolve internal party disputes. Uddhav Thackeray cannot be reinstated
The court noted that there was no communication with the Governor to indicate that the dissident MLAs wanted to withdraw support from the government. The Supreme Court held that the decision of the Governor of Maharashtra was not in accordance with the Constitution of India. The Supreme Court says that the Speaker should decide the disqualification petitions within a reasonable time. The Supreme Court further said that status quo cannot be restored as Uddhav Thackeray did not face the floor test and tendered his resignation. The CJI said that if Uddhav had not resigned, he would have been reinstated.
