How is the election of mayor, know the whole process
As per the Delhi Municipal Corporation Act, it is mandatory for the local urban body to hold elections every five years to determine which party has the majority to remain in power. Section 35 of the Act states that the civic body should elect a mayor in the first meeting of every financial year.
The majority party will nominate the councilor’s name
However, the party having a clear majority in the house can nominate the name of the councilor for the post of mayor. But, if any opposition party opposes the decision and nominates its candidate, an election will be held. If there is only one candidate from the party in power, they will be appointed mayor. In the case of an election, the candidate with the most votes will be elected mayor.
Any councilor can vote for any candidate
Separate nominations are made for the election of the mayor if the other parties are not satisfied with the name nominated by the ruling party for the mayor. Voting for mayor is done by means of a secret ballot. The lieutenant governor nominates the presiding officer for the election of the mayor. Since the anti-defection law does not apply in municipal elections, any councilor can vote for any candidate. However, in case of a tie between parties, the presiding officer appointed to oversee the election conducts a special draw of lots and the candidate whose name is drawn will be the Mayor.
